Should You Play or Pay? ACA’s Employer Sledgehammer Penalty Explained

Employers must soon decide whether they are going to ‘play or pay’ under the Affordable Care Act (known as ACA or health care reform). Under this particular provision, employers with 50 or more employees face penalties if they don’t offer health insurance coverage or if the coverage they offer is insufficient.  The penalty for not offering coverage–known as the ‘sledgehammer’ penalty (or Penalty A)–is explained by John Hickman of Alston & Bird LLP (www.alston.com).  Hickman also addresses the question of whether it’s better for employers to play or pay to the audience at BLR’s  Advanced Employment Law Symposium (AEIS) in Orlando, Florida.  Learn more about AEIS at http://AEISonline.com
