In states and municipalities where gender identity discrimination is prohibited, covered employers generally must allow a transgender individual to use single-sex facilities (e.g., restrooms) consistent with the individual’s gender identity. But if an employer has a single-occupancy restroom, it can require the transgender individual to use it to protect the privacy of all employees.
