When an employee complains that a supervisor or co-worker is harassing or bullying them, or engaged in discriminatory or other illegal conduct, an investigation is often required to resolve the matter.
HR managers have a balancing act to perform in preventing retaliation, says Attorney Judith A. Moldover. You've got the manager storming around, saying "I'm going to get this person—can I fire him today?" And you've also got a complaining employee who is strutting around thinking he or she is bulletproof.
Retaliation suits are the one type of EEOC suit that is increasing, and Attorney Judith A. Moldover says HR managers have an "incredible role" in sparing their organizations the expense those suits invariably bring—even if you "win" them.
Things are getting really busy, and now employee A wants FMLA leave, B has jury duty, and C needs an accommodation. It can be frustrating, but employees have rights, and it's foolhardy to challenge them.
In almost every case, when you investigate the underlying cause of an employee lawsuit, you'll find that the manager or supervisor either caused it or could have prevented it.
