IBP Workers Receive Their “Walking Time” Checks






In late 2005, the U.S.
Supreme Court ruled that the federal Fair Labor Standards Act requires
employers to pay for time an employee spends walking to his or her workstation
from a changing area after donning required protective gear. The case involved
production line workers at the IBP Inc. meat processing plant in Washington State. Now, the nearly 800 employees affected
by the lawsuit have begun to share in the $8.5 million judgment, with more than
half collecting more than $10,000 each. And more funds could be on the way. In
a companion case to expand the class of workers and time period for which back
pay is required, a district court last July awarded another $11.4 million. An
appeal in that case is still pending in the Ninth Circuit Court of Appeals.
