Medical Staffing Firm Hit With $3 Million Assessment for H-1B Visa Violations

The U.S. Department
of Labor (DOL) has charged that Advanced Professional Marketing, Inc., a New York City medical
staffing firm, owes $512,000 in fines and $2.9 million in back wages for
various H-1B visa rule violations. The company brought 156 H-1B guest workers
to the United States from
the Philippines
to work as physical therapists but didn’t pay them required wages, the DOL
says. The H-1B program mandates that workers here on these visas be paid at
least the same wage rates as American workers are paid to perform the same
types of work or the prevailing wage rates in the areas of intended employment.
The DOL also contends that Advanced Professional Marketing used incorrect
prevailing wage rates on labor condition applications filed in connection with
the visas and didn’t maintain required documentation.
