Two former employees sued Chipotle Mexican Grill, Inc., challenging its policy of requiring employees to purchase slip-resistant shoes from a vendor as a condition of employment and deducting the cost of the shoes from employees’ paychecks without obtaining their written authorization.
The employees asked the court to certify a class of approximately 26,000 nonexempt current and former employees of Chipotle in California to pursue the deduction issue and other wage and hour violations.
The employees claimed the deductions caused their wages to dip below minimum wage. They also alleged that Chipotle’s pay stubs improperly failed to include the start date for the pay period, which was a violation of the law even if the start date could be deduced by counting back from the end date.
