Most California employers know by now that a California appeals court recently issued an important decision in Brinker Restaurant Corp. v. In a long-awaited ruling that could put the brakes on some wage and hour class actions in California, an appeals court has provided welcome guidance and relief to employers on their responsibility to provide meal breaks and pay for “off-the-clock” work.
Brinker Restaurant Corp., which operates Chili’s Grill & Bar, Romano’s Macaroni Grill, and Maggiano’s Little Italy restaurants, was hit with a class action lawsuit on behalf of 59,000 restaurant workers, charging that Brinker failed to follow California meal and rest break rules.
