Mexican Food Chain To Pay Big For Overtime Misclassification






Carlsbad-based Rubio’s
Restaurants will shell out $7.5 million to settle class action lawsuits
charging that it misclassified managers, thus failing to pay them for overtime
and missed meal and rest breaks. The settlement covers managers and assistant
managers who worked in Rubio’s restaurants in California at any time in the past decade.
Rubio’s has denied the charges, stating that it agreed to settle out of court
to avoid the time and expense of protracted litigation. The settlement is
awaiting an Orange
County
court’s approval.
