Felix C. Villafuerte complained to the Labor Commissioner that Pasadena-based Inter-Con Security Systems Inc. never paid him his final wages when he quit. Inter-Con claimed it had mailed a final paycheck to Villafuerte but that an unknown person had illegally intercepted and cashed it by forging Villafuerte’s signature. A California Court of Appeal now says that illafuerte was never “paid” because there was no evidence that the check was ever delivered to him. The court explained that when an employee quits, their final paycheck must be delivered within 72 hours at the employer’s office. The check can be mailed only with the employee’s consent, which Inter-Con apparently had not obtained.
