Employment-Related Cases on the Supreme Court’s Docket This Term

As the first Monday in October rolled around last week, the U.S. Supreme Court was back on the bench, with new chief justice John G. Roberts.

One of the key employment-related issues the court will consider this term is whether, under the Fair Labor Standards Act, workers must be paid for the time they spend at work waiting to receive and return their required protective gear, as well as for time spent walking to and from their workstation and the gear distribution stations.

The court will also rule on whether the First Amendment protects a deputy district attorney from job retaliation for writing a memo to his supervisors charging a deputy sheriff with lying on a search warrant affidavit. The issue is whether the attorney’s speech addressed a matter of public concern even though it occurred during the course of carrying out his job responsibilities.
