Federal Court Strikes Down Rule On Trucker Hours






A federal appeals court
has invalidated a Federal Motor Carrier Safety Administration (FMCSA)
regulation that relaxed strict limits on the driving hours of truckers.
1 The court found that the
agency adopted the regulation in 2005 without adequately justifying its reasons
for increasing the permissible driving hours. The regulation boosted the
maximum driving hours from 10 to 11 per day. (This is the second go-round for
the rule. The same court struck it down in 2004 after it was adopted by the
FMCSA, which then reissued the rule a year later.)

 

In response to the latest
decision, the FMCSA stated: “We are analyzing the decision issued today to
understand the court’s findings as well as determine the agency’s next steps to
prevent driver fatigue, ensure safe and efficient motor carrier operations, and
save lives.”
