Some jobs require employees to be able to perform particular physical tasks. An employer may require applicants for those jobs to submit to a medical exam before beginning work. In certain circumstances, you may even require a current employee to submit to a medical or “fitness-for-duty” (FFD) exam to ensure that he can perform his job duties.
However, as one Nebraska employer recently learned, the standard for requiring current employees to undergo an FFD exam is much higher than the standard for job applicants. Read on to learn about the standard adopted by the Nebraska Supreme Court in this recent case.
