Employment Law Tip: Don’t Forget to Post Voting Rights Notice

A special statewide election will be held on Tuesday, Nov. 8, 2005. Polls will be open from 7 a.m. to 8 p.m. The California Elections Code requires employers in the private and public sectors to allow employees to take paid time off to vote if they don’t have sufficient time outside of work hours, but you don’t have to pay workers for more than two hours off, and you can require them to go at the beginning or end of their work shift. Employees must give you two working days’ notice if they know in advance that they’ll need time off to vote.

Also, you must post a notice about employee voting rights for at least 10 days before the election. This notice must be posted either in the workplace or where it can be seen by employees as they enter and exit their place of work.
