The Department of Homeland Security (DHS) has announced that for 45 days, until October 21, 2005, the I-9 employment eligibility verification rules will be relaxed for victims of Hurricane Katrina who are seeking jobs but can’t produce the required I-9 documentation. Many victims lack these documents as a result of evacuations, loss or damage, and ongoing displacement in shelters and temporary housing.
In particular, the DHS says it won’t sanction employers that hire workers who were evacuated or displaced by the hurricane and are otherwise eligible for hire but currently don’t have access to the original documents required to establish identity under the I-9 rules. The DHS says employers must still fill out the I-9 verification form for such individuals as completely as possible and should note on the form that the new hire’s identity paperwork isn’t available due to Hurricane Katrina. At the end of the 45-day period, the DHS will review the policy and make further recommendations.
