The U.S. Department of Labor has revised the poster that employers are required to post in the workplace to inform employees of their rights under the Uniformed Services Employment and Reemployment Rights Act (USERRA). USERRA sets out employment reinstatement and benefits rights for service members, and it applies to all employers regardless of size, including federal, state, and local government employers.
Private employers and state/local public employers can download the new poster version here. Federal agency employers can download the version that applies to them here. The notice must be posted in the locations where you customarily place notices for employees.
Also, in another military leave development, the U.S. Department of Labor (DOL), in an effort to educate employees and employers about their rights and obligations regarding military leave and reinstatement, has released final regulations under USERRA. The new rules go into effect on Jan. 18, 2006. We’ll have full details in the February issue of the California Employer Advisor.
