The Department of Labor
has sued Glendale-based Janitorial Carpets Maintenance for allegedly
misclassifying workers who cleaned movie theaters in
California
misclassifications have resulted in violations of minimum wage, overtime pay,
and recordkeeping rules, and the DOL is seeking at least $900,000 in back wages
and damages for work performed between July 2003 and July 2005. The lawsuit
also charges that some employees brought relatives to work with them to help
complete heavy cleaning loads within the required timeframe, but the
relative-helpers weren’t paid for their work.
