A new measure introduced in the U.S. Senate would remove existing caps on compensatory and punitive damages an individual can recover in an employment discrimination lawsuit. The new legislation, titled the Equal Remedies Act of 2007 and authored by Sen. Edward Kennedy, D-Mass., is aimed at eliminating damages caps that were implemented a decade and a half ago under the Civil Rights Act of 1991, which limits the damages that can be recovered in suits filed under Title VII or the Americans with Disabilities Act to between $50,000 and $300,000, depending on an employer’s size.
Well keep you posted on the status of this and other measures of importance to employers.
