A California Court of Appeal has upheld a decision to deny disability retirement benefits to a San Diego city utility worker. Before he started working for the city, Charles Alesi injured his knee several times while jet-skiing and in a beach football game. He then reinjured the knee twice at work and once more while again attempting to jet-ski. The city denied his request for disability retirement benefits because its plan requires that the disability be caused solely by an injury arising out of employment. The court said that San Diego’s municipal charter lawfully permitted the city to include such restrictions in its disability retirement plan.
