High Court To Review U-Haul’s Class Action Waiver Case






The California Supreme
Court has decided to review a recent appeals court ruling upholding a class
action waiver in U-Haul Company of California’s
mandatory employment arbitration agreement. The provision at issue stated that
by signing the agreement, the employee gave up “any right to bring claims on a
representative, class member basis, or as a private attorney general.” When
employee Ron Konig filed a class action suit against U-Haul alleging various
wage and hour violations, U-Haul successfully argued that the arbitration
policy barred the class claims. However, the Supreme Court’s grant of review
means that the appeals court decision is no longer good law.
