New Legislation Aimed At Eliminating Wage Bias





Federal legislators are
considering two new measures to combat wage discrimination. The Paycheck Fairness
Act (S. 766 and H.R. 1338)—introduced in the House of Representatives by Rep.
Rosa DeLauro, D-Conn, and in the Senate by Sen. Hillary Clinton, D-NY—would
expand the amount of damages employees could be awarded under the federal Equal
Pay Act and add new nonretaliation provisions.

 

The Fair Pay Act—introduced
by Sen. Tom Harkin, D-IA—would: 1) amend the Fair Labor Standards Act to bar
wage discrimination based on sex, race, or national origin; 2) require
employers to provide equal pay for jobs that are comparable in skill, effort,
responsibility, and working conditions; 3) bar employers from reducing wages to
achieve pay equity; and 4) require public disclosure of employer job categories
and their pay scales.
