Make-Up Time: Sample Policy and Request Form




Last month, we guided
you through California’s
make-up time rules. Here we provide a comprehensive sample make-up time policy
and request form.

 

Make-Up Time Policy

A nonexempt employee who
requests time off for personal reasons may voluntarily make up the lost work time
as follows:

 

1. The make-up time must
be performed in the same workweek as the lost work time. [Company’s] workweek runs
from [specify the workweek, e.g., Sunday to Saturday].

 

2. Including make-up
hours, an employee may work no more than 11 hours on a make-up day and no more than
40 hours for the workweek.

 

3. On each occasion an
employee desires to make up lost work time, the employee must complete a Request
for Make-Up Time form. The request must be approved in writing by [specify,
e.g., immediate supervisor] in advance of the day(s) on which the make-up hours
will be worked.

 

4. An employee who knows
in advance that he or she has a personal obligation that will recur at a fixed
time over several weeks may submit a make-up time request up to four weeks in
advance. The make-up time must be performed in the week that work time is lost.

 

5. Make-up hours worked
under this policy will not count as overtime.

 

6. If approved make-up
time is not worked, the corresponding lost work time for that workweek may be
unpaid.

 

[Optional: 7. If
approved make-up time is worked in advance of the time off, the employee must
take that time off even if it is no longer needed for personal reasons.]

 

[Company] will not
solicit, encourage, or require employees to request make-up time. An employee’s
decision to use the make-up time option is voluntary.

You can use this form
for employee requests to make up hours—without daily overtime—for work time
lost because of personal obligations.

I am submitting this
request to work additional hours to make up work time I missed or will miss for
personal reasons. I will work the make-up hours in the same workweek that the
time is lost.

that I may request make-up time up to four weeks in advance for a fixed,
recurring personal obligation.

 

3. By law, the make-up
hours will not count toward calculating overtime unless I work more than 11
hours on a make-up day or more than 40 hours in that workweek.

 

4. If I take the
requested time off but do not work the corresponding make-up time, the time off
may be unpaid.
