Sony Settles Big Overtime Suit

Sony Computer
Entertainment America will pay up to $8.5 million to settle a California class action lawsuit charging
that the company erroneously classified certain workers as exempt from
overtime. According to the lawsuit, these employees, whom Sony called “image production
employees,” produced, installed, or copied pre-made images into video games,
using commercial or in-house software programs. They had no management responsibilities,
and the details of their work were closely supervised and didn’t involve
creative judgment. Thus, the employees contended, they didn’t qualify for
overtime exemptions under California
law.

In connection with the
settlement, Sony said it does not admit any liability or wrongdoing. The
settlement awaits court approval.
