Does pregnancy leave have to be paid?
Our HR Management & Compliance Report: How To Comply with California and Federal Leave Laws, covers everything you need to know to stay in compliance with both state and federal law in one of the trickiest areas of compliance for even the most experienced HR professional. Learn the rules for pregnancy and parental leaves, medical exams and certifications, intermittent leaves, required notices, and more.
Neither California nor federal law require an employer to pay an employee during a pregnancy disability leave, even if the employee is receiving benefits under the state Paid Family Leave Insurance program. This is true unless the employer pays for other temporary disability leaves or if the employee elects to use accrued vacation or sick leave during an otherwise unpaid pregnancy leave.
More information on the Paid Family Leave Insurance program is available from the California Employment Development Department website. — CELA Editors
