The Family and Medical Leave Act (FMLA): What Workers Need to Know Today

Proposed changes to the FMLA may be confusing employees about just what the law allows. This PowerPoint® plus booklet program may help set them straight as to what the current law actually says.

Robert J. Gilson is a consultant to federal agencies on HR matters, and before that, he was an employee relations director for the government. So he likely knows what problems plague management in dealing with their employees.

“The number one cause for employee discipline in the federal sector results from problems related to leave,” he recently wrote on the website, FedSmith.com.

Gilson recommends steps to curb leave abuse, as other experts have (see yesterday’s Daily Advisor.) But Gilson adds one focus they didn’t. That’s an emphasis on

having employees understand the rights and responsibilities of leave. He calls for leave policies that are “readable, communicated to employees, and consistently applied,” and “effective internal public relations tools” that get the information out.

It’s likely that the need to clearly communicate leave policies is increasing.

With the recent hubbub over possible major changes in the FMLA —including loudly- proclaimed statements by presidential candidates about expanded and paid leave, there’s been a lot of publicity over what is and isn’t allowed now, and what may be in the future. Just what do your employees think they’re entitled to? And is there a “readable” means of communicating accurate information about the FMLA as it currently exists, and as it likely will for some time to come?

One tool that fits that description is BLR’s PowerPoint plus booklet training kit, FMLA: What You Need to Know. Here are some of the key understandings the kit’s creators have included:

–What constitutes eligibility for the FMLA leave? Some employees may think the FMLA leave covers any malady and is available from the first day of work. They need to know that it covers only serious health conditions (and how that’s defined), relating either to their health or that of an immediate family member, or the birth or adoption of a new child. In any case, they are not eligible until they’ve worked for you for at least 12 months, with 1,250 hours worked in the last year.

–Certification requirements. They need to understand that, for medical leave, professional certification of the need for leave will likely be required, and that this requirement may be repeated every 30 days – at their expense.

–Notice requirements. While leave may be taken in either a block of days or intermittently, workers need to know that employers must receive notice, and in what time frame that notice must be given.

–Benefit provisions. Employees may not know that although you are required to maintain their medical benefits, they must continue paying their portion of the premiums during leave. Also, other benefits can legally be suspended or dropped.

–Return to work NOT guaranteed. Many workers may not realize it, but the FMLA includes provisions that could bar their return to work, or make them take a lesser job. Employees should know the “fine print” about return to work before they decide to request leave.

The FMLA: What You Need to Know program is written in plain-English, and is fully illustrated. It includes 25 PowerPoint slides, slide show notes , a quiz with immediate answers, and 20 copies of a full-color booklet stressing all the main points in the presentation. Additional booklets are available at a discount.

Priced at $99, the kit could be that “readable” instrument for communicating leave policy that stops confusion before it starts. You can order it, on a satisfaction-assured basis, by clicking on the link below.
