Fired for Policy Violation or FMLA Leave?

The U.S. 8th Circuit Court of Appeals recently had to decide whether an employee was rightfully terminated for policy violations or was unlawfully retaliated against for taking FMLA leave.

Novo hired Aubree Ebersole in March 2007 to work as a sales representative in the Poplar Bluff District, which covers roughly the southern third of Missouri.
