Nine of 10 Employment Class Actions in 2010 Involved Wage and Hour Claims, Says Law Firm

Of all class and collective actions filed in 2010 claiming employment law violations, 91 percent involved federal and/or state wage and hour claims, according to the law firm Littler Mendelson LLC.

Federal and state wage and hour class and collective actions filed during the 2010 calendar year totaled about 3,785 nationwide, according to data collected by the law firm. The other 9 percent primarily included discrimination cases and cases brought under the Employee Retirement Income Security Act, with the remainder claiming violations of the Family Medical Leave Act, the Americans With Disabilities Act, the Worker Adjustment and Retraining Notification Act, as well as of state employment laws, most prominently in California.

Littler Mendelson is the only source to gather comprehensive filing data on class and collective actions in the area of employment law, Garry Mathiason, senior shareholder at Littler’s San Francisco office, told Smart HR Manager.
