Employers covered under the Family and Medical Leave Act must have the U.S. Department of Labor’s poster hanging by COB March 8.
In February, the U.S. Department of Labor issued new regulations that implement and clarifiy amendments to expand military leave entitlements under the Family and Medical Leave Act. In addition, the final rule: (1) increases the scope of qualifying exigency leave to include parental care; (2) extends military caregiver leave to include care for veterans with a serious injury or illness; (3) enhances job-protected leave for airline personnel and flight crews; and (4) updates the FMLA optional use forms.
In conjunction with these new regulations, DOL has made revisions to its mandatory poster — Employee Rights and Responsibilities under the FMLA. Employers must begin using the updated poster no later than March 8, 2013, the effective date of the final rule. DOL has noted that employers may start using the poster before that date.
All employers covered by FMLA — generally public and private employers with 50 or more employees — are required to display the FMLA poster in a conspicuous place accessible to employees and applicants. The poster summarizes the major provisions of FMLA and tells employees how to file a complaint. It must be displayed at all worksites, even if there are no FMLA-eligible employees.
